Workers Compensation Leave
Workers Compensation Leave is leave the employee takes when he/she has an industrial injury. Workers compensation is covered by an Insurance Policy the employer provides for employees as a benefit. The first three (3) days of workers compensation leave are not reimbursable to the employee by the Insurance Company, but if the employee qualifies may be taken as sick leave, which the employer may or may not pay for. After the three (3) day elimination period the Insurance Company will compensate the employee according to a compensation schedule. Excluded from coverage are self-employed persons and those persons who volunteer their time to religious, charitable or non-profit organizations, county or municipal entities unless the organization or agency elects to provide coverage.
Employers are expressly prohibited from discharging, threatening or discriminating in any way against an employee because he/she has received an award from, has filed or even intends to file an appeal with Workers Compensation Board.
